A case of considerable importance to gas companies operating under agreements vith local authorities came under the notice of rfis Honour Mr. Justice Button, in Chambers, yesterday. The Feilding Borough Council brought an action against the- Feilding Gas Company, Ltd., for a decree declaring thu agreement between tho parties to bo ultra vires, and for an injunction to restrain tho council from interfering with the streets in connection with the gas mains. Mr. Yon Haast snid the parties wv-.ro agreed ,to state ;t. special case. His Honour made an order by consent removing the case inlo tho Court of Appeal for argument.
