Henry Chas. Taylor. This was a case on appeal from the decision of Dr. M 'Arthur, in the Magistrate's Court Taylor claimed to recover £8 3s 9d for 131 hours' work, performed on various public holidays. It was admitted that he remainod in the employ of tho firm, that he did not present himself for work on th«, holidays, and that he was not paid for such holidays. Ho came out from England and entered into an agreement to work for the firm for two years, anil thereafter for such period as' might be agreed upon.' The magistrate found that it was not tho custom of the trade to pay for holidays, but gave judgment for Taylor for £6 2s 6d, and jCI 16s costs, the assumption being, said Mr. Justice Cooper, that Dr. M'Arthur considered that the contract and the award negativ- ' ed the custom. The firm now appealed against the judgment on the grounds "that there was no evidence to support' the judgment ; that tho facts proved entitled defendants in the Magistrate's Court to judgment.; that the award in the trade did not entitle him to bo paid for holidays ; and that it was proved that the, custom of the traclo was that holidays -should not bo paid for.^' Mr. Young appeared for appellants, and Mr. Levvey for respondents. The agreement provided respondent should receive 60s a week' for 48 hours' work, but no referonce wns made to holidays. Tho argument submitted for respondent was that appellants were bound to provide the work stipulated and pay. for it. After 'lengthy argument his Honour said he would take time to consider. Mr. R. P. Flanaghan announces that he has been appointed manager of Lyons, Limited, c»rriap;e and 'bus proprietors, as from to-day. Mr. Flanaghan has resided ■for over tWenty-five years in this city, tvhoro ,ho has been connected in business as proprietor of ' Conveyances for public traflic, and also witb the Cab Proprietors' Union. Lyons, Limited, notify that they have a largo and UD-to-date plant.
