An application in reference to the sheep brands of E. J. Riddiford was mentioned in the Magistrate's Court today before Mr. Riddcll, S.M. Air. Skerrett, X.C, appeared for Mr. Riddiford, and Mr. Findlay for the Stock Department. Mr. Skenrett said litigation had been going on between the parties for some time. • The first application came beforo Dr. M' Arthur, S.M., to strike out a wool brand and a cattle brand belonging to Mr. Riddiford. Included in that application was an application to strike out a sheep brand, wnich wa6 the subject of tho present proceedings. The matter was heard and dismissed by Dr. M'Arthur, S.M. The judgment of his .Worship was by statuta 'conclusive. The next step in the matter was when Mr. Findlay instituted proceedings against Mr. Riddiford — in which the latter was subject to large penalties — because of a defect in the registration of his brand. The matter came before Dr. M'Arthur, S.M., and his Worship dismissed the information. But on appeal his Honour Mr. Justice Cooper reversed the ' decision, and the matter had still .to come before Dr. M'Arthur, S.M. ; to consider what penalty he should impose. Mr. Riddiford had applied to correct the earmarks in accordance with the original findings, and that was the application at present before the court. Counsel suggested that Dr. M'Arthur, knowing all the facts of the case, should hear the application. Mr. Findlay submitted that Dr. M'Arthur would be- the first to say that he would feel himself hampered by the fact that he had already decided a similar question. Mr. Riddell, S.M., said he would consult his colleague on the matter. Both counsel stated that they would be prepared to, have the matter considered by a court consisting of both magistrates. To-morrow, at 2 o'clock, Messrs. W- H. Morrah and Co. will aejl by public auction, in their rooms, Willis-street, household furniture and effects, a,nd a small lino of drapery, jackets, etc. Mr. Frank L. Wise, of Wise's Directories, has established an office in Wellington at 5, Lambton-quay, in connection with the firm's publication*. He insert* an announcement in this i£sus.
