SAND-DRIFT SCHEME.
AN EASTBOURNE APPEAL. John Cameron, Muritai, farmer, appealed this afternoon against the apportionment of £120 as the cost of the sand-drift scheme in respect of a piece of land situated in the Borough of Eastbourne, containing about three acres, being part of section 45 Harbour District. The court consisted of Dr. A. M'Arthur, S.M., and Messrs. W. G. Foster and E. G. Pilcher, assessors. The appeal was against the Minister of Lands. Mr. Troadwell appeared for Mr. Cameron, and Mr. Organ for the Eastbourne Borough Council. Mr. Treadwell outlined the sand-drift scheme, and said the Borough Council, instead of rating tho wholo of the borough for tho purpose of this tax, had devised a scheme by which it had cut out a large part of land which appeared to be the worst part of this sand-driffc area, and the council was attempting to levy on this particular part of tho borough a tax differentiating into three parts. He did not know how the borough arrived at its conclusion. Tho President: Wo have no means of ascertaining how they arrived at their conclusions. Mr. Treadwell said ho had nothing to go upon except certain figures which he had culled from the Gazette and Government departments. Ho asked the court to strike out any area not benefited by tho scheme, or add any area likely to bo affected by driftingsand, as provided by the Act. The statute, ho said, contemplated that the whole of the tax should bo thrown upon the land to be' benefited by the scheme, and he would show that an area outside tho proclaimed area was as liablo to sand-drift as the land proposed to bo taxed. The proclaimed area was spocially rated £617 ss, of this amount the appellant and another gentleman were taxed to the extent of about £250. In answer to Mr. Treadwell Mr. Organ staled that the assessment was on tho, basis of area and not on tho basis of value. Mr. A. P. Moeon, surveyor, was giving ovidonco in support of counsel's statement as wo went to press.
