ALLEGED LIBEL.
• A RACING CASE. * [BT TRI.KORAm — I'KESS ASSOCIATION.] GISBORNE, Bth September. A caso of considerable interest to sporting circles was commonoed in tho Supremo Court to-day. William Miller M'Kinnon sued David John Bany, brewer, for £200 for alleged libel. The enso arose over Medallhm, tho Grand National Hurdles winner at Christchurch. M'Kinnon rodo Medallius in tho Waiapu Cup on 26th March (a non-totalisator mooting). Defendant was «lloged to havo accused plaintiff of "pulling" the horse and culling him a thief and a swindler just after the nice. Tho all** gation as to "pulling" had been struck out, and it was contended for tho defence that this count having been disposed of by his Honour at a previous ! sitting, it was not compotont to bring a second action. His Honour reserved bis decision on tho point. The main defence wns a deninl of the allegation, but that if tho words had been used it was in tho heat of tho moment and with no malicious intention.
