The City Advance and Deposit Company anil the Official Assignee.
Tho caso in whioh tho City Advance and Deposit Company sought to compel tho Official Assignee to admit a proof of dobt for J81995 against the cstato of W. R. Waters was heard in the Bankruptcy Court to-day, Mr. Justice Richmond presiding. Mr. Travers appeared for tho Official Assignee, who filed an affidavit that he had rejected the proof because the company bad failed to tako propor proceedings against Waters for embezzlement. Mr. Edwards appeared for the company. Mr. Edwards submitted that as tho Official Assignee had rejected the proof of debt, that gentleman should state his reason for such a step. Mr. Travers said that he had instructed the Official Assignee to make such an application. Tho Official Assignee had to do his duty to the other creditors, and if tho City Advance and Deposit Company condoned an offence they took a certain risk upon themselves. After some argument, in the course of which Mr. Edwards contended that the company had not had sufficient grounds to justify them in the expectation of obtaining a conviction by a jury, his Honour reserved judgment.
