(Before his Honor the Chief Justice. ) TAYLOR AND ANOTHER V. O'REILLY. Mr. Bell moved for judgment by default in this case, supporting his application by an affidavit that the writ had been served on defendant on 27th of May, and was returnable on 28th June. The defendant had not pleaded in defence. His Honor granted the application. TRIBE V. WATT. Mr. Bell moved for taxation of costs in this case, in the absence of Mr. Hutchison. After a long discussion, the matter was ordered to stand over until next sitting day, Mr. Travers undertaking to stay execution in the meanwhile, without prejudice. •* On the application of Mr. Travers, the cases of M'Kenzie v. Hall and another, and Somerville v. Groves, were ordered to stand over until next sitting.
