The Havelock Committee had refused a iijtme and then granted it upou an Order-in-Council being issued validating a technical omie&it>u. Sir James Prendergaat said the Order-in-Oounail could not stand good, as the Governor had no power under the licensing Act to is?ue it. The committee therefore acted without legisk'ive authority, and he ordorcd that a writ of certiorari be issued quaehiDg the certificate. Bic Kobert Stout appeared for the Maoris, who were the plaintiit'e.
