The defence in the Lyttelton case began this morning - , counsel claiming a non-suit on a number of grounds, principally that it was not proved the company was incorporated. No notice of the action had been given by plaintiff, the Board was not liable, and no actual negligence was proved. The jury were dismissed till Monday, while the points are argued. In the R.M. Court the point was raised that some of the Auckland oysters seized by the police were not rock-oysters, because they grew on the kelp. Witnesses for the prosecution said they were rock-oysters plucked in the clo3e season, and put into mud. The case was adjourned to get evidence of Dr Hector, as an expert, whether they were really rock-oysters.
