ADJOURNED MEETING OF CREDITORS OF T. W. MARSH.
An adjourned meeting of the creditors of T. W. Marsh, was convened at the Brunswick Hall at noon, yesterday, and largely attended. Mr. A. Beveridge was called to the chair, and said the meeting had been summoned to receive the report of the gentlemen appointed at the previous day's meeting to examine Mr. Marsh's stock for the satisfaction of the creditors. Mr, J, T. Gablick (accountant) then read the following statement :— "Ec T. W.Mabsh's Estate, Gboceb, Auckland. " The undersigned, who were appointed, by a meeting of creditors held yesterday, to value the stock and inquire into other assets of the estate, have, after a thorough investigation of the same, to report as follows :— Stock and fixtures in Queen-street £ s. d. store valued at 554 5 1\ Stock in Symonds-street store ... 366 15 6£ Total £921 1 2 Book debts (after deducting what we consider bad and doubtful debts, and those in which we know there are contra claims) ... 250 0 0 Goods in bond 90 0 0 Land at Epsom, worth to the estate at least, £200. Bills in Bank for collection (names S. Stuart and W. H. Dempier) 256 14 9 Cash in Mr. Marsh's possession... 70 0 0 Balance to his credit at the Bank 15 0 0 Total £1,602 15 11 Liabilities about £3,000 0 0 (Signed) "John Abbott. " J. T. Gablick. "Auckland, November 8, 1867." Mr. Abbott explained that the stock in the Queen-street shop was anything but good, and if precipitately realised, instead of the goods fetching £921, they would not turn in more than £800. The stock at No. 1 shop was good, and would sell for its full valuation. They had carefully analysed the accounts, and, from his own knowledge of those doubtful and bad,£2so was the extreme amount that could be realised. In reply to an interrogation as to when the debts had been contracted, Mr. Abbott said the debts were rotten, and only put down to swell out the list of assets. Mr. Jones said it appeared to him it was possible to realise about 10s. in the pound, and the question was whether they should accept that sum or put the estate into Court. There were £1,500 worth of assets and £3,000 liabilities; and if they intended to take 10s. they should do so at once, or put him into Court and endeavour to keep him there. He might pay 12s. 6d. down with the assistance of some of his numerous friends, and he for one felt inclined to save his cash. Mr. Abbott said he would be " saving his bacon," for only last week Mr. Marsh advertised for a hand for the bacon counter, and they found the whole stock of bacon was only valued at 30s. Mr. Lewis asked if there was not a property in Wellington-street which had not been given up. The Chaibman said he was about to call attention to that. The property alluded to was sold by Marsh to Collins, who had mortgaged it again to Marsh. The mortgage had been foreclosed. Mr. Mobbin said the property was worth very little. The Chaibman said he had been asked to lend £400 on it a short time ago, and a client of his felt inclined to do so, but something occurred to prevent it. Mr. Abbott said the debts crowded in extended over a period of ten years, whilst the liabilities were all contracted within the past two months. After a discussion amongst the creditors it was resolved to make immediate application for the arrest of the insolvent, on charges of obtaining goods under false pretences ; and the meeting then separated.
During the afternoon, Mr. Marsh was apprehended by detective Ternahan, charged, on the information of Mr. Stannus Jones, with obtaining goods to the value of £120 under false pretences, and lodged in the police-station. He will be brought before his Worship at the Police Court this morning.
