TUESDAY, Dec. 6.
' Larceny. Bernard Dowd and John Dowd, two brothers, |he younger about 9 or 10 years of age, were apprehended, charged with stealing a quantity of rope from a cutter i in Freeman's Bay : the younger prisoner, John Dowd, pleaded guilty. Robert Fielder, sworn, said— He was a shipwright and boat-builder, residing in Victoria-street. On Saturday last he missed six pieces of rope, the running gear or his cutter, then lying in Freeman's Bay ; that ha accompanied the Sergeant-Major of Police to the boat of the' prisoner, in the same Bay, and saw him discover the rope under the timber board of the boat ; that now in Court was the rope in question ; its value was 205.; the younger prisoner was on board, but saw nothing of Bernard Dowd. Henry Syms, Sergeant-Majoy of Police— On. Satur* day afternoon last witness informed me that the nuv nipg gear of his vessel had ben stolen ; I aooompanied him to the cutter worked by the two prisoners, and found some rope under the lining boards, which the prosecutor identified as the rope stolen from his vessel ; the younger prisoner, John Dowd, waa on board ; subsequently I apprehended the elder prisoner, he being | the master of the boat; on conveying them to the^ lock-up he persuaded the younger prisoner to plead guilty, in order that he, the elder prisoner, might not get into a scrape; the younger prisoner at first denied, but, on being pressed by hii brother, he confessed it. i About 11 o'clock on Saturday night I was near the lock-up, and heard the prisoner, Bernard Dowd, call out to a prisoner in the adjoining cell, " Jack, tell that brother of mine to mind what he does to-morrow — to plead guilty, and say I was not there, and that I knew nothing of the matter" ; he also said " Tell my brother to aay that it was 10 o'clock on Friday night when he stole the rope, and that I did not return until 3 o'clock on Saturday morning ; that he hid the rope under the lining of the vessel for fear I should see it ; also, to mind what he is about when they cross question him, for if they get me in there they will hang me J tell him, also, to inform the Magistrate that if I had seen the rope I should have made my brother return it." Witness further deposed that Bernard Dowd had already been convicted of larceny, in the Resident Magistrate's Court, and received six months imprisonment. Cross-examined by prisoner, JB. Dowd — I heard you make use of the expressions I have just stated. Robert Fielder re-called, said— From the position in which the running gear was left it was possible for the younger prisoner to have taken it by himself ; it wm| taken from an 8 ton cutter. "™ Remanded till to-morrqw.
Themas Orutchley, seaman of the "Jane," was then brought up from remand ; Capt. Comstook not appearing the prisoner was discharged. Three drunkards were then disposed of : two of them were find ss. each, or 24 hours' imprisonment ; the other 10s., or 48 hours. Bridget Kennedy was charged by Margaret Purcell with assaulting her on Saturday, the 3rd inst. — Charge withdrawn.
