NOTES AND COMMENTS Catalogue For Melbourne (By The Watcher.) Wings <>f Song is not eligible lor the I’uhi Maiden Plate at. Otaki, which is for horses that have not won a race at the time of starting. He will, however, be eligible for the Trial and Noviee at Wellington. Names. ~ , , 'The filly by Leighon irom Host has been named Isis, and the filly by Bulandshar from Ilathor will be known Siynna. The former is a first foal. The latter is a half-sister to Host, Shu and Hagen.

First in New Colours. Dainty Sue had her first, race in her new colours in the Marton Handicap. She is not forward and was never prominent.

Satisfactory. For a fresh horse whose Inst race was in April. Play On ran satisfactorily on Saturday in the Marton Handicap. lie occupied a good position in the running, and although he was not able to finish on, it looks as if he is fairly forward for events ahead.

Looks Well. The Rabbi four-year-old Barabbas appears to have benefited by his spell, and he looked particularly well when paraded at Marton on Saturday, but after missing the jump away he was never seriously in the contest.

Should Not Bo Long. Prior to Marton Sudan had not raced since the Auckland Easter meeting. Her form on Saturday suggests I hat she will not take long to come right.

Second Cup. Catalogue is to leave for Melbourne this week. He is making the trip alone. With the exception of the first two Melbourne Cups in 1861, and 1862, won by Archer, uo horse has succeeded in winning in two successive years, and '.Peter Pan, who won in 1932 and 1934, is the only horse beside Archer who has won it twice.

Schooling Jlishap. The jockey, J. F. Fergus, received a bad shaking and abrasions to the head ■when Cintraee fell while schooling at Ellerslie on Saturday, lie was sent to his home, where he received medical attention.

Beaulivre Doing Well. MTien S. Reid returned to Hastings last week with Kathbella he left the crack three-year-old Beaulivre at Avondale under the care of the Auckland trainer IL Eva. Beaulivre is thriving on the useful work he io being allotted, and it is expected that he will strip in the pink of condition for the Great Northern Guineas on Saturday week.

New Zealand Cup Meeting. Au acceptance for the New Zealand Cup will be due at 5 p.m. on Friday. Nominations for the Stewards’ Handicap and other major events at the cup meeting will close at the same time.

Australian Racing. Svdney cable messages state that Defaulter was scratched on Monday for all Randwick- spring engagements and also the Melbourne Cup. High Caste-was also withdrawn from the Melbourne Cup. Ashley Reed, of Melbourne, has been engaged to ride the popular Epsom candidate Adios in the Epsom Handicap. The prominent Metropolitan candidate Feminist will be ridden by AV. Cook instead ot Lappin, whose skull was fractured in his fall in the Rowley .Mile on Saturday.

No Protest From Owner. After Lady Don’s win at. Oran on Thursday there was some talk of a protest being lodged on the ground that the lillv had been prepared by an unlicensed trainer, but Mr. G. Hull, owner of the runner-up (St. Cloud) declined to allow this to be done on his behalf. The matter was taken a step further on Saturday, when an inquiry was instituted by the stipendiary steward; and the outcome was that Lady Don was disqualified for the race, and' her owner, and the unlicensed trainer, R. W. King, each fined.

Gold Salute. Gold Salute, who is now being discussed as the likeliest danger to Beau Vite in 'the A.J.O, Derby, is bred on very similar lines to Defaulter, being by a Hurry On horse, out of a Paper Money mare. Gold Salute's form <may not be equal to that of Beau Vite, but Disalto, who beat him first start in Sydney, is a high-class welter performer.

New Owners. The Iliad —Joy Princess colt Locnan introduces to the'list of owners two newcomers in Messrs. T. M. and T. J. Brennan, well-known Wellington hotel hosts. Both, father and son. hold a joint interest: in the colt, which had ils first outing with the colours 1 up in the Juvenile Handicap at Marlon on Saturday. Missing the jump out Locrian was not knocked about, being allowed to run his own race, behind the'field. lie is in the ■stable of R. C. Penman, Trentham.

Interesting Comparison. A number of horses handicapped for the New Zealand Cup this year were also entered for the Melbourne Cup, and the weights they have been awarded in the two big two-rnile races are as follows:—

The New Zealand Cup weights closely follow the Melbourne Cup weights, except in the case of Dictate'and Yours .Truly.

The Melbourne estimate of Yours Truly seems to be out of all reason, but possibly a proper outline of this horse's, form was not forwarded to Victoria, as in the Caulfield Cup he was given 5.4, only 31b. loss than Peerless and lib. more than Sly Fox.

The Lady Don Case. The disqualification of Lady Don opens up the question as to what is the definition of a trainer and the duties that must 'be fulfilled by a person holding that .position according to the Rules of Racing, says "'Sentinel.” Some time ago a horse was a winner in New Zealand and got the stakes, although the trainer "was in Australia and had been located there for some considerable time. If an owner trains his own horse or horses it must, according to the rules, be under his direct personal supervision. Strictly speaking, that would mean that the owner has. to be in constant attendance at the training stable and training tracks as attendance at the former may be just as important as the' latter. If, however, a horse’s attendant had general and fairly .strict instructions' as to feeding, exercise, and track work to cover a week or a month’s operations, it could be held . that the training was done under the direct supervision of the owner without it being necessary for a day-to-day attendance at the stables and training tracks. There is no definite period mentioned as to how long a horse should or must be under a person’s charge before being considered the trainer, according to the Rules of Racing. If a person buys a horse two or three days before, or during the course of a meeting, and a change of stables occurs, the trainer’s name may be changed without question, and this seems to be a point worthy of consideration in the Lady Don case. If Lady Don had won at Ashburton, where she appeared as being trained by R. AV. King, then she became automatically disqualified. A breach of the rules was then recognized, and Lady Don appeared in the Geraldine book as trained bv owner. King disappears as trainer, hut although not holding a licence, can still act as an attendant not requiring a licence. The fact that King did not apply or hold a trainer’s, licence does not necessarily debar him from acting as an attendant or stable-help. He could be relied upon satisfactorily to carry out the care of a horse drained under the owners direction. It could be held that Mr. Hunter was the trainer at Geraldine and King merely acting as a stable-help. Otaki Acceptances.

Acceptances for the Otaki-Maori spring meeting to be held on Saturday will close tonight at S o’clock.

Wellington Nominations. Nominations for the spring meeting of the Wellington Racing Club on October 19. 21 and 23. also forfeit for the AVellesj ley Stakes, will close on Monday at o p.m. Answers to Correspondents.
