JUDGMENT AGAINST COUNCIL
Two Lower Hutt Cases Judgment for plaintiff in two cases taken against the Lower Hutt Borough Council in connexion with the settingback of the street line in High Street, Lower Hutt, was given by Mr. A. M. Gouiding. S.M., in the Magistrates’ Court, Wellington. Judgment for £43/6/10 and £7/13/costs, was given Elbe Bros., Ltd., who claimed £75/9/10 for breach of contract by deprivation of the premises and for damage to stock. A. C. Stevenson claimed £157 from Mrs. H. B. Reynolds, and £6O from the council for trespass without consent, deprivation of business, and because of trespass damages through inability to quit stock (luring the period of notice to quit the premises. Judgment was given for A. C. Stevenson for £3O/10/-, with £5/1/6 costa, against Mrs. Reynolds, and £36 and £5 1/6 costs against the council. Mr. W. D. Goodin conducted -the cases for the plaintiffs, Mr. C. R. Barrett appeared for the council, and Mr. R. I. M. Sutherland for the owner, Mrs. H. B. Reynolds.
