Fatality At Brooklyn

Evidence in support of a claim for £2OOO general damages and £lB special damages by the widow of The victim of a fatal accident in McKinley Crescent, Brooklyn, on April 2 was heard by the Chief Justice (Sir Michael Myers) and a jury of 12 in the Supreme Court yesterday. Plaintiff is Isabella Veale, and she is suing on behalf of the daughter she and her late husband adopted, aged 19, as well as for herself. Defendant is Charles Grindle Baker, Island Bay, clerk. Mr. A. J. Mazengarb is appearing for plaintiff and Mr. W. E. Leicester, with him Mr. 0. Evans-Scott, for defendant. Mrs. Veale alleged that her husband was knocked down and fatally injured by defendant’s car while her husband was crossing McKinley Crescent to his home on the eastern side of the street, and that the accident was due to defendant’s negligence in travelling too fast, failing to keep a proper look-out, sound his horn, give, way, keep control of his vehicle and stop or steer clear. At the time of his death Veale was earning £5/2/7 a week as a carpet planner at the D.I.C. His age was 63. Defendant denied that he had been negligent and alleged 1 that the accident was deceased’s fault in that he elected to run across tire path of the car when he knew, or should have known, that it was unsafe to do so. It was alleged, further, that if the driver Was negligent then the pedestrian contributed to the accident by his negligence. Addresses by counsel and his Honour’s summing up will be heard this morning, when also the jury may visit the place where the accident happened.
