Legality to be Tested ACTION PENDING AT SYDNEY By Telegraph. —i’resg Assn. —Copyright (Received March 19, 11 p.ni.) Sydney, .March 19. A statement of claim in the pending suit which will test the validity of race broadcasting in New South Wales was lodged with the Equity Court this afternoon. The nominal plaintiff iu the action is the Victoria Park Racing and Recreation Grounds Co., Ltd., which is asking for an injunction perpetually restraining the Commonwealth Broadcasting Corporation Ltd. (station 2UW) from transmitting descriptions of horse races during the progress of meetings at the Victoria Park racecourse. Joined as defendants are the broadcaster, Cyril Angles, also the owner of certain land adjoining the racecourse. Ou this land is an observation tower from which broadcasting is conducted. Plaintiff claims that broadcasts of races have depreciated the value of its land and diminished the profits from tlie racecourse.
