Sequel to Mine Accident COMPANY WINS CASE By Telegraph.—Press Association. Auckland, March 22. In a judgment delivered to-day Mr. Justice Ostler has held that by section 67 of the Workers Compensation Act the right of John Gordon, a Waihi miner, to damages against the Waihi Gold Mining Company is limited to £lO9O. Gordon was one of the victims of the Waihi cage accident last July, and the warden’s court assessed his damages at £l5OO. It was contended on behalf of defendant company, said his Honour, that plaintiff’s right to damages was limited to £lOOO by virtue of section 67 of the Act. On behalf of plaintiff it was contended that there was no such limit. The question for the opinion of the court was whether defendant company’s contention was sound in law. As defendant company had been successful in the argument, his Honour awarded it £l2/12/- costs, to be deducted from the amount of damages.
