CLAIM SUCCEEDS
Compensation for Carrier Judgment for plaintiff in a compensation case brought by Henry Arthur Hall. Wellington, carrier, against Robert Nellsoh Hall, trading under the name of A. Hall, Wellington, carrier, was given in the Arbitration Court yesterday by Mr. Justice Frazer. His Honour awarded full compensation at the rate of £2/3/4 a week until January 9. 1934. and thereafter for the remainder of the period of liability at the rate of 13/- a week.
Mr. O. C. Mazengarb appeared for plaintiff, and Mr. W. E. Leicester for defendant.
In his statement of claim plaintiff stated that on January 28, 1933. lie was working in the employ of defendant unloading bars of iron from a wagon when one of them fell on him and he suffered a compound fracture of the left leg. As a result he had been incapacitated from the time of the accident down to the present time, and had been advised that his disablement would continue for some time to come. He had received from defendant payments on account of compensation payable under the Workers’ Compensation Act, and now claimed such, further relief as the court might deem just. The defence did not deny the circumstances of the accident, and the only substantial point at issue was the method to be used in calculating plaintiff’s average weekly earnings.
