DAMAGES AWARDED
Hataitai Hospital CONFLICTING EVIDENCE There was a sharp conflict of evidence during the hearing of a claim for damages in the Magistrate’s Court yesterday concerning the lease of a nursing home and hospital at Hataitai. Elizabeth Reenberg (Mr. Treadwell) claimed £26/8/9 for shortages in stores and £2O general damages from Kathleen Elizabeth Carlyle (Mr. Hollings). The evidence showed that on or about July 14, 1928, an agreement was entered into between the plaintiff and the defendant whereby the plaintiff agreed to let to the defendant a nursing home and hospital at 9 Hinau Road, Hataitai. There was a clause in the agreement which stipulated that the premises and contents must be kept in good order and repair, and the plaintiff claimed that when the defendant handed over the hospital on October 26, 1930, certain stores were missing and repairs had to be done to the amount claimed. After hearing the evidence, Mr. E. Page, SAI., pointed out that it was unreasonable to expect linen to last indefinitely. It was unfortunate that defendant did not complete the checking of the inventory. He allowed plaintiff £lO, with court costs £l, solicitor’s fee £l/11/-, and witnesses’ expenses £l/0/6. The defendant is at present matron of the St. Catherine’s Hospital, Marton.
