SALE OF HOTEL
DISPUTE OVER COMMISSION. Before Mr. Justice MacGregor in the Supreme Court yesterday Alice Herdman, proprietress of the Railway Hotel, Marton, appealed against the decision of Mr. J. S. Barton, S.M., who recently gave judgment for £lOO in a claim brought against the appellant by C. Dickinson and Co.. Ltd. The. respondent company, had claimed £lOO in thee Magistrate's Court, alleging that it was Jhe sum agreed upon for commission for the stile of the hotel in question, and alternately that £lOO was only reasonable remuneration for the services rendered to Miss Herdman. The Magistrate gave judgment for Dickinson and Co., Ltd., stating that in his opinion the- company was entitled to the full amount claimed. It is against this decision that the appeal was made, the question being whether the respondent
was entitled to the commission on the case made out. After legal argument had been heard, the Court reserved its decision. Mr. H. F. O’Leary appeared for appellant and Mr. 11. 11. Cornish, and with him Mr. 11. J. B. James, for respondent.
