THE MORATORIUM
“ASTONISHING RESULT” CLAIMED By Telegraph—Press .Association. Ashburton, February 4. The “Guardian,” editorially, says that an astonishing result followed the recent controversy respecting the moratorium. Die daily papers in the four cities invited leading commercial lawyers to express an opinion on the effect of tho moratorium on the Statute of Limitations, which cancels debts affected-if they are left dormant for a certain period. The replies in the four cities showed that. New Zealand lawyers are sharply divided on the essential point. The Christchurch and Auckland lawyers stated emphatically that the moratorium suspended the Statute of Limitations; the Dunedin and Wellington lawyers, including Sir Francis Bell, declare that the moratorium did not suspend the statute. It is therefore a fair deduction that half the lawyers in the. Dominion, have possibly advised their clients tffat' they . need not proceed against defaulting debtors till the moratorium expired. As the Attorney-General’s declaration shows that such advice is absolutely erroneous, the ippeal that Parliament should repair the omission by passing a short law retrospectively suspending the statute during the moratorium appears unanswerable.
