Mr. Justice Chapman yesterday delivered the reserved judgment of Mr. Justice hawards (who is indisposed) in the case: ol Mary Waddiuetou v. Annie Itcdmoml. Xm action arose out of the will of the late Mrs. Sarah H'Leau M'Laren, of Feildins. The residue of her estate was directed to he sold and the net proceeds divided between several relatives of the deceased in equal shares "as joint tenants." Some 01 these relatives had died when the time arrived for distributiiiE the proceeds 01 sale, and the survivors claimed that tncy wero entitled at law to the whole proceeds by virtuo of the use of the words "joint tenants" in the will, which implied a rit'ht of survivors to take the whole interest aa against the children or oUiei representatives of the deceased beuencinrics. Tho representatives of tho deceased beneficiaries, on the other hand, contended that the words ,".ioint tenants, tnouwi having the technical meaning ascribed to theni by the plaiutifl wero shown by tuc will as a whole to havo been used maavertently, and that therefore the representatives of the deceased beneficiaries were entitled to share. f His Honour held that the contention ot the survivors that they were entitled to the whole proceeds was unfounded, and that the representatives of the deceased beneficiaries should take an equal shar* of the proceeds. Mr. F. Haggitt, of Feildiqj, appeared lor plaintiff, Mr. h. Elliott, of FjeiUmp, for the trustees of the will, and Mr. T. Weave for the representatives of the deceased beneficiaries.
