A LAND AND STOCK DEAL CLAIM AND COUNTER-CLAIM In the .Supremo Court yesterday, His Honour M_i Justice Chapman heard a claim by Alcsauder Duncan Al'Lauchlan, of Blenheim, commission agent, against John Black, of Blenheim, sheep-farmer, for £370. There was a counter-claim by defendant for £558 10s. Plaintiff claimed that defendant entered into a contract with him to purchase his right, title, and interest in tho Government pastoral license, No. 149 a., of tho grazing areas known as Leatham. Defendant entered into possession of the lands and stock, and fulfilled all tho conditions of tho sgreement except a final cash payment of £450. Plaintiff admitted a shortage of 160 sheep, for which he allowed the sum of £80 to bo deducted. The amount of his claim was, therefore, tho balance of the £450, vis., £370. Defendant stated that ho entered into possession of tho lands.and stock relying upon the representations made by plaintiff that the stock were of a certain ago and nature. Be admitted that he had not paid plaintiff, the sum of £450, but alleged that the sheep obtained wero not of the ago and description agreed to bo delivered. He further alleged that plaintiff knowingly misrepresented to him tho ages of the Hock, and ho counter-claimed from plaintiff £158 10s., boine for 6heep short, and also £400 as damages. Plaintiff's defence to tho counter-claim was that the sheep on the nlaco were in nccordance with any representations made by him. Mr. H. P. O'Dcary appeared for plaintiff, and Mr. A. W. Blair for dsiendant. Tho case was not concluded when tho Ciurt rose. AUCKLAND SENTENCES By Telegraph—Press Association. Auckland, July 18. In tho Supremo Court to-day the following prisoners were sentenced:—James Gray Keane, for theft, two years' reformative treatment; William Ernost Jasper, theft from the person, twelve months' imprisonment. MAGISTRATE'S COURT POWCE AND INDICTABLE CASES. Mr. S. E. M'Carlhy, S.M., presided at Iho Magistrate's Court yesterday, and dealt witn the police cases. Theresa Kussell was charged with'loitering in Tory Street-for immoral purposes, also with being an incorrigible rogue and. vagabond in that she habitually cousorted with reputed prostitutes, she having been Sreviously convicted as a rogue and vagaond. Accused was convicted, and sentenced to two years' imprisonment. An articled seaman named George Gore, a member of tho crew of an oversea vessel, was sentenced to a month's imprisonment for deserting from his vessel. A fine of £3,' in default 14 days' imprisonment for bring found drunk in tho bar of the Te Aro Hotel, was- imposed on ftuncis Edward Gordon. For insobriety, James Donovan was fined 405., with the option of seven gays' imprisonment. Bernard llikaisan, found helplessly drunk in Lambton Quay, was ordered to pay medicaL expenses. 17s. 6d., in default seven days' imprlsonm_.it. Molly Bradley-W43 also ordered to nas; medical expenses, r/s. 6d. William Charles Aubrey, charged with an aggravated assault on Bella Graham by striking her on the face with a bottle, waa remanded to July 25, bail being allowed in £60 and one surety of £50 or two sureties of £25 each. A remand to July 25 was also granted in tho case of Hubert William Cough, charged with blackmail with intent to ektort or gain the sum of £50 from Alice Laughton, by threatening to accuse her of an offence. Dennis* William Quill was charged that, on June 21, he did steal a silver watch and chain, valued at £3, the property of William Banniiln, of the Thistlo Inn Hotel, Tho watch was stolen from a bedroom of tho hotel and sold to a second-hand dealer for 7s. 6d. Accused pleaded guilty, and was committed to tho Supremo Court for sentence. Charles Thomas Luxon was charged before Mr. W. G. Kiddell, S.M., with having committed bigamy by going through a form of marriage on June 13, 1917, with I Emily liydia Barker, his lawful wife Lilian Luxon being then alive. Chief Detective Boddam prosecuted and Mr. H. •H. Cornish represented accused. It was disclosed in the ovMenco that tho legal marriage took place before the Egistrar of Marriages in July. 1916, and tho alleged bigamous marriago on June 13, 1917. the latter being solemnised by the Sov. J. K. Aroher. Whon arrested by Dotectivo Itawlo accused said: "I married again because I was led to believe that my first wifo was already a married woman. I make no bones about it. I tell tho truth." Accused then made some inquiries about Court procedure, and Eaid: "I'll plead guilty to save trouble." Accused pleaded not guilty and was committed to the Supreme Court for trial. Bail was aUowed as previously.
