APPEALS FOR THEOLOGICAL STUDENI

DISMISSED

In reply to questions by Captain Walker, he admitted that on the date on which he was served with notice under the section ho had two brothers of military age, and neither of them waa at tho front. One brother, however, had sinco, gone to the front, and another had been balloted and rejected for heart disease. Appellant was willing to bo put into tho ballot to take his chance there, but he felt it a hardship to have tho slur of Section 3.1 cast on him.

Mr. Jf'Laren said that those who considered that Section.'l 5 east a slur on anyone wore reading into tho Act something that was not there.

The board further adjourned the case for a month.

The appeal of William Charles Oscar Johnson' was dismissed, the Financial Assistance Board having made certain recommendations favourable to appellant. Decision was reserved upon the appeal made by Clarence Eric Kce on the ground' of undue hardship. Mr. F. S. Pope (Live Stock Division) appealed on behalf of Arthur Elliott Kauisay, assistant meat inspector, Wniapoa. The board adjourned the case siuo die.

Mr. Young, secretary of the New Zealand Seamen's Federation, applied for exemption for a number of seamen. The board reserved its decision sine die in the cases of all except the following:— Alfred Holmes, George Banks, Thomas Henry Wilson, Arthur Nixon, and John .1 affray. The appeals of the five men named were dismissed, and the appellants were granted leave till July 21.

.Mr. .Young asked for reinsertion of the appeal of Patrick Francis M'Namarii. The appeal hart been recently dismissed, but the only point of importance in the matter was the length of the period during which appellant had been nsiibre before joining the vessel to which he at present belonged. M'Namara gave evidence yesterday that he was a thoroughly qualified seanuui with fifteen years' experience. Ho had been ashore recently for six months, as he had been rendered temporarily unfit for his calling through an operation. The board adjourned the case sine die.

Archbishop O'Shea appealed for the exemption of Patrick Francis M'Carthy, John Alexander Higgins, and Joseph Victor Spillane, theological students at Greenmeadows College. Mr. H. F. O'Leary appeared in support of the appeals.

Archbishop O'Shea slated that each of tile students was in the last four years of his course, and had taken temporary vows.

To. Captain Walker: Those vows could be abandoned. They were not like the final vows, but were only, vows of obedience. Sixteen in New Zealand had gone away in connection with military service. Twelve were at the front, two were on hospital ships, l and two were in the camps. One of the priests at the front had recently been killed. The board dismissed the appeals. Appellants will be granted leave to July 21. Harold Hook and Owen Stanley Hurncy, partners in a grocery business in Cuba Street, asked for two months in which to settlo thoir affairs. Leave iill August 22 was granted. In the following cases, in which decision bad been reserved, ih'e board dismissed the appeals, Captain Walker undertaking to obtain leave for the appellants (ill July 24:—Ernest William Hash (Wellington), Victor Robert Simpkiss (New Plymouth), ,T. .1. Hannan (Hawcra), Richard W. Battcrsby (Wellington), Henry James Fell (Shannon), Heinricli F. Yosseler (Bltham).
