SUPREME COURT !A. WAIKATO LAND DEAL', In the Supreme. Court yesterday Mr. Justice Hosking heard a case which arose out of a deal in Waikato land. Herbert Hengley and Leonard Guest, farmers, Auckland, claimed against Richard Keene, of Wellington, for specific performance of a contract to exchange land. Certain damages, also, were claimed by plaintiffs. The plaintiffs said that an agreement was entered into by the parties to the action under whioli they were to sell to Keene (for other land and money) a block of 1338 acres of land near Cambridge, known-as "Monavalo." However ; after delay, Keene refused to specifically perform the contract. The plaintiffs asked the Court to order performance of the contract, and to award them £150 special damages, and to give the costs of tho action in their favour. An alternative claim by the plaintiffs was for £1000 damages for breach of agreement, and £150 special damages, and costs.: Mr. H. H. Ostler appeared for the plaintiffs. The defence consisted in certain objections to plaintiffs' title to "Monavale!" Messrs. M. Myers and 0. Beere represented the defendant. The.hearing of evidence was unfinished when the Court rose for the day.
