The Supreme Court yesterday and to-day was. occupied in hearing a case in which Margaret Corliss sued tho Marlborough Timber Company for .£2OOO damages in connection with the death of her husband, John Corliss, at Oporiri Viillev, when the company's engine was derailed. It was agreed (li.it evidence in one case would ba applicable to tbe other, tho same verdict, if any, to be accepted. Considerable evidence was called with the object of showing that defendant's tramline from which tho engine had been derailed was defective; that deceased, though he had knocked off work for the day, was still in the employ of the company, while on tho way lrom the bush to the mill; that fho rate of speed of the engine was excessive.
The defence was that the line was a suitable om?,"and that deceased was on the engine at his own risk. Mr. O'Rognn, of Wellington, oppeared for claimants, and Jtr T O. Russell, of Ciiristchurch, for defendant. The verdict was for £.«w damages.-.
