MAGISTRATE'S COURT.

(Boforo Mr. W. G. Riddell, S.M.) MILKMEN UP AGAIN. On the information of Carl Albert Schauer, inspector, two dairymen named .1. B. Cooper, of Muritai, and F. W. Petherick, of Wellington, were charged with selling milk containing a certain quantity of water. ITis Worship, in granting an adjournment (applied for by Mr. Wilford for defendant), said that ho would require eyidenco as to what steps defendant had taken to satisfy himself that tho milk had been up to standard tests after ho had received it. Tho case is to be contained on October 25. Regarding tho case of F. W. Petherick, Mr. If. L. Machell, who appeared for defendant, entered a plea of guilty, and a fine of 10s. with costs was imposed. Another milk case of a different kind was also heard. In this 011 c tho inspector took action against J. Keirby for selling milk containing less than 12 per cent, of total solids and less than 3.25 per cent, of fatty solids. Defendant, for whom Mr. E. J. Fit&giblwn appeared, was fined 405., with costs I9s. Gd., in default 48 hours' detention. PLEA FOR SEPARATION. In tho case in which Ella Norton mado application for a separation and maintenance order against her husband, Geo, Norton, Mr. ,T. ,T. M'Grath (for defendant) contended that the ease must fail, because tho proceedings had been brought under Sections 75 to 80 of tho Divorco and Matrimonial Causes Act, 1008, which had been repealed by Section 87 of tho Destitute Persons Act, 1910. Counsel further contended that the proceedings had been wrongfully initiated by information instead of complaint. His Worship agreed, and dismissed tho information. Mr. E. G. Jellicoo appeared for informant. TJIE WIFE'S SUIT. Eliza Blatcher made application for a separation and maintenance order against her husband, Chas. Ulatchcr. Bis Worship granted the request, and ordered defendant to pay the sum of 12s. (id. per week towards the maintenance of his two children. OTtDER- DISOBEYED. Geo. Garstoin was fined 20?., in default seven days' imprisonment, for disobedience in respect to a maintenance order. Garstein made application to havo tho order cancelled in respect to his 10-year-old child. The magistrate granted this request, but (old applicant Hint ho would bo liable for the arrears in respect of same. GUARDING THE STREET WAY. The Onslow Borough Council proceeded against Arthur Kilmister for allowing two cows to wander. Mr. P. W. Jackson appeared for tho council, and Mr. T. S. Weston for defendant. For (he defence it was contended that there was no evidence to prove that tho cows were (ho property of Kilmister, and on this ground, his Worship dismissed the information. A solicitor's fee of uue guinea was allowed against the council.

Jlenry A.shworlh was fined 10s., and costs Ts., in default 48 hours' detention, lor leaving a vehicle unattended. For being in an unsobcr state whilst being in charge of a horse and cart, A. 11. Fiillford was fined 10s„ and costs amounting to 1/s., in delault 48 bourn* imprisonment. A charge wa,s preferred against J. Osborne of having wilfully impeded traffic ill Cuba Street and Lnmbton Quay on September 21. Mr. J. O'Sliea, City Solicitor, stated that this was a very bad case, „ anil defendant, who did not appear, wan lined 10s., and costs amounting to 215., 1 in default 48 hours' detention. James Nairn was lined IDs., and costs, f in default 48 hours' imprisonment, for f allowing three cows to bo at large. . Patrick Covauagh, for allowing 15 sheep to 1)0 at largo, was mulcted in a penalty ~ of 20s. and costs, in default 48 hours' 7 detention. J). J. Matthews and William May wcro r each lined fis. and costs for allowing their horses to wander. The alternative in j each case was 21 hours' imprisonment.
