SUPREAIE COURT. KING'S ROAD, MIRAMAR. 'IX. CHAMBERS.' The question of the narrowing of King's Road, Miramar, from 'JDi't. to (ih'fl., winch gave rise to so much controversy at : :.ie Into municipal election-;, is now' to bo argued before the Chief Justice. On Saturday morning his Honour had before him in Chambers an application by the Miramar. Borough Council for au'ord?r removing a. caveat which had been lodged by Hector Xornian M'Leod to prevent the registration of an order of the council diminishing King's Road to G6ft. Mr. T. 'louiig appeared for the council and Mr. Martin Chapman, K.C., for the caveator. Mr. Chapman suggested that as the matter was of public interest tho AttorneyGeneral should be represented. His Honour said the same thought had occurred to him. The point was important. Mr. Young said the District Land Registrar' had been served, but did not think it necessary to appear. _ His Honour said that if any man was injured by any act of a corporation he was entitled to., compensation. Ho presumed a man could suo in connection with the narrowing of a road. To suggest that tho council had the power to deprive a man of the frontage of his section -was an, extraordinary thing. If that were, so the shops on Lambton Quay would bo closed. Mr. Young: But the people would receive compensation. In tho Te Aro- reclamation everybody's frontage was taken. His Honour intercepted Mr. Young, who was beginning to go into the facts. The Government, his honour said, must be represented. "A public road does not belong to the municipality alone. It is the King's and although the freehold is granted to the municipality it is a question how far you can go." The matter was adjourned for a few days in order that the Attorney-General may be represented.
