Captain Varawa has commenced a new action against tho Howard-Smith Company, claiming ,£25,000 damages for false imprisonment in connection with .the sale of the steamer Peregrine during'the Rus-so-Japanese War. In a former action Varawa obtained a verdict for'vCsooo, but.the verdict was upset on appeal. ■ . . Prior to his arrest in Sydney in January, 1905, Mr. Varawa was engaged in negotiations with the Howard Smith Shipping Company for the purchase of its steamship Peregrine, on behalf of the Russian Government, then at war with Japan. The company, following the negotiations, had ■ instituted proceedings against Varawa for breach of agreement, and he was arrested when leaving New South Wales, and held in Darlinghurst Gaol on a writ of capias for eleven days till security for JE4OOO was forthcoming. A previous action brought by him, in which he claimed .£20,000 damages, was heaTd in the Victorian Sapreme Court in June last, and the jury, finding in his favour, awarded him .£SOOO damages. On appeal, however, tho State Full Court set aside the findincr, on the ground that the plaintiff should have had tho writ set aside before he brought his action in the Victorian Court.
