POINT IN NAUTICAL LAW.
CAPSIZE OF A CUTTER. (By Tclceraph—Press Association.) Auckland, March 11. The Nautical Court opened this morning to inquire into the capsizing of the cutter Kiwi off Howick. Two of the. crewgot ashore safely next day, and the cutter righted. It was found that tho topmast had snapped off, but there was but little other damage. The question was raised as to tho Court's jurisdiction, section 233 of tho Shipping and Seamen Act, 190S, authorising an inquiry, "where material damage has been done." Counsel quoted the Queen's Bench caso in the collision of the s.s. Gertie and s.s. Penguin, in which the Nautical Court suspended the certificate of a second officer. Mr. Justice Cooper allowed tho appeal, holding that the Court was not entitled to suspend a certificate, except where "serious damage had been done." Sir. Kettle, S.M., agreed that tho point required serious consideration. He. adjourned the inquiry forthwith for that purpose.
