ALLEGED BETTING HOUSE.
AVANGANUI CASE DISMISSED.

Wanganui, l-'ebruavy 28. -Air. ICorr, 8.31., delivered judgment this morning in (he case in which Farrell was charged with keeping a bettinshoiiso in ii certain stable. 'The polico evidence showed that defendant was known to the police by reptile as a bookmaker, and on several uecasions when races were being run in different parts of the Juminion defendant ami a number of men entered a room in the stables used as an office and bedroom. On the, afternoon of February £!, defendant was arrested in the ollieo when he was writing in a small book which Hie magistrate said ho was satMied contained particulars of bets jiiade by defendant nt (otulisator odds with persons whose real names were concealed under pseudonyms. -Air. Hutchison, for defendant, raised the point that defendant was not affected by the sections of the Act under which the information was laid, and that there was no evidence except that l-'arrell had used the office and that people came and went and that the premises were used as a livery stable. Counsel held it would have to be proved that defendant was a sort of tenant of the. owner of the property.
ilic magistrate uphold the contention, and said there was no evidence that the owner or occupier of the stable had knowledge of what defendant was doin" or that he permitted defendant to use the ollieo or bedroom for the purpose of betting, and dismissed tho case.
