Dtinn appeared for plaintiff, and Mr. Blair for dofendnnt De-' .fendant m6ve& for an order "setting aside the Becunty which had been found tor tho coits of appeal, on the ground that the affidavit , Sled in rospect of the financial portion of tho kurety was alleged to,contain incorrect particulars. After / hearing argument,' tho Judgo mado an order cancelling tho security, and allowed-costs to defendant. , FITZGERALD AGAINST GOW. Another Case mentioned was that of Maud Eleanor Titagornld v. Andrew Mouat Gow A claim had been made by lira Pitzgerald (mortgagee) against Gow (as mortgagoftiin de-> fault), tor possession of property in Sydney Streot. Judgment had been entered for plaintiff'by default. 'Mr. Bolton appeared for plaintiff, and Mr. Dunn for dofondant. Defendant ujpplied for ant. order setting aside the judgment, upon the,ground that he had a defence by reason of sofne arrangement with the second mortgagees of the property.
