DAMAGED CARGO.
A TEST CASK. , ■ ; (BY ' TELEGRAPH—PRESS , ASSOCIATION.) Auckland, October 2. Judgment was given, at the S.M. Court to-day in tho test case in connection with the dispute arising out of the damaged condition in which some of the cargo of the Frenchsteamer Briez Izel arrived in' Auckland on September 18. The vessel's No.-2 hold was flooded during the voyage, resulting in damage to some of the cargo stowed there. The plaintiffs were J; Burns and Co. and Heather, Robertson, and Co., and the defendant was Captain Alex. Cadet, master of the steamer. Burns and Co. claimed .€24 lis; and Heather, Robertson, and Co. claimed £19 14s. <ld. The magistrate said the case, was a peculiar one. The damage was not.occasioned by sea water which came aboard during a storm, but by water which came through, two manholes when the tanks were tilled. Looking at all the circumstances, lie was of opinion that the captain had .erred in ordering the water to be turned into the. tank without first seeing that the manholes were secure. Ho was thorefore guilty of-neglect, and judgment would bo given for plaintiffs.
