TWO VITAL Stipulations were:— (1) Each side' to deposit > loser's deposit to be forfeitod toiY.M.C.A. (2) Mr. Irwin permitted to choose Supervising . Committee. ' This Challenge definitely declined by Mr. Irwin on September 3. . . - SECOND CHALLENGE :- By advertisement in The .Dominion of September "5, 9, and 12, setting out terms for public information. .This differed from First Challenge on TWO VITAL POINTS (1) -Mr. Irwin not required to risk any deposit. Wo alono deposited .£IOO with Manager of The Dominion. (2) Neither side any special rights re appointment of-'Committee. The published Challenge was accepted on September 10. Mr. Irwin submitted the foliqwing conditions (inter alia) for consideration of the Committee, in a letter to tho • Manager l - of The Dominion :— (1) A Gregg and a Pitman Student to bo selected from the respective institutions to submit to a test. , (2) The test to be held "at our (Gregg •Institute's) earliest convenience." (3) COMMITTEE, to arrange examination for Gregg student. (i) Examination Paper for Pitman-stu-dent to be set by MR. IRWIN. (5) Examination papor of Pitman student to, be marked by. some person to be - nominated by MR. IRWIN. Apparently these conditions did not afford tho Gregg systom all tho protection it required, for Mr. Irwin claimed also that ho was to choose all the members of the Supervising Committee. We suggested that, as the Challenge stipulated no method, each party should nomiuate two persons, and the four thus selected should chooso the fifth. We nominated A. W. Kitson, Esq., and'H. F. Allen, Esq. On September 23 we wrote:'"lf your conditions are adopted by the Committee to be appointed, wo are bound, by terms' of Chaljengc, to accept .them, and we aro willing to do so." On September 26 we wrote: "We hope for your own sake you will advance matters a stage by either accepting our suggestion re appointing a Committee, or making a bettor suggestion;" On September 29 the Manager of The Dominion wrote to Mr. Irwin to the effect that the test appeared to be only waiting the appointment of Committee, and pointing out that his persisting in his claim re method of appointment would necessarily throw a doubt on his willingness to go on with the test, and dostroy public confidence in lest. Mr. Irwin's reply was his advertisement of October 1, in which he BACKS OUT of his acceptance, and ingeniously tries (o cover an inglorious rotreat by creating confusion between the two Challenges. Ho wishes to read into tlie Challenge which ho accepted, ONE ONLY' of tho important stipulations in tho prior Challenge which he refused.
