CHARGE OF ARSON.

Thomas Fitzgerald was again before tho court this morning in conncction with Newmarket arson chargo. When the chargo was read to the prisoner ho made no reply. "Very woll,"' said his Honour, "tho prisoner stands mute. I order a plea of not guilty to be entered." The jury was empanelled, tho prisoner betraying not tho slightest interest in the proceedings or manifesting in aiiy way that ho comprehended them... No fewer than twelve of the jurors called were ordered to "Stand asido" by tho Crown Solicitor (the Hon. J. A. Tole, K.C.)'. The jury retired at one o'clock, returning _ twelve minutes later with a verdict of guiity. His Honour said it was his duty to sentence prisoner, and hfe must sentence him as a sano person convicted of a serious crime. If he were really insane he would not be kept in prison but sent to a place where insane people were kept. The sentence of the court would bo five years' imprisonment.
