James Irasio ..was, charged with obtaining- under false pretences from Paterson.and Barr the sum. of £4 7s. 3d. on June 12, 1907. Accused elected to be tried by jury. The evidence, for /the prosecution was to the effect that accused:'was adjudicated a bankrupt on August 29,.'1907,■ also that ho gave a' mortgage to Wm. Frascr Edmond for a sum of £590 55..9d.0n May 25, 1907', and a bill of sale over liis stock to Win. Fraser Edmond on the same date, giving collateral security over the" business, chattels, and book debts! Accused had no other assets outside cf the two deeds mentioned. Bankrupt's .unsecured liabilities on June 10, 1907, were about £420. "The estate realised £425. On June 10," 1907," accused was insolvent. Othor evidence was to the effect that when accused was approached by Paterson and Barr he' asserted ho was perfectly solvent, and made a statement showing a surplus of assets of £400 over liabilities. Accused pleaded npt guilty, "and was committed for trial. '
