Justices Buckley and Kennedy granted the appeal of Lord Howard do Walden (who holds a largo portion! of tho,.'former Portland estates, through his marriage with tho' sister of tho late fifth Duke) against a decision permitting Robert Caldwoll's evidence in tho coining civil action to bo taken on commission. The Court held that Caldwell was a crucial witness, and that it was essential that his story should ho tested before a jury. ,\ \ The Dr. Shaw mentioned yesterday gave ovidenco in tho will suit brought by Mrs. Druco against the executors of T.'G. Druce in 1001.
