Farmers let off
Two farmers who were threatened with prosecution for ignoring a ban on irrigating from the Cust River last summer have been let off the hook.
The North Canterbury Catchment Board decided last February to prosecute the farmers for ignoring an irrigation ban.
But the board’s solicitor now believes a prosecution would probably fail because of the wording of the conditions of the farmers’ water rights. As a result, staff will in future seek legal advice on the wording of water rights before they are issued.
All rights on the Cust River expired this year and have been renewed with the new wording.
