TO MEDICAL PRACTITIONERS You are NOT obliged to refer a woman for an abortion merely on her request. Under the Crimes Act and the abortion law it rests with you to decide first if grounds exist. The law says: “(2) If, after considering the case, the woman’s own doctor considers that it may be one to which ... Section 187 A of the Crimes Act 1961 applies he 5ha11...” (Contraception, Sterilisation & Abortion Act, Section 32(2).) The Crimes Act in the main requires serious danger "to the life or mental or physical health of the woman or girl (not being danger normally attendant upon childbirth).” The New Zealand Medical Association resolved (4/12/1985) that certifying or performing an abortion solely on grounds of unwanted pregnancy, social inconvenience, economic difficulty or failed contraception, or any combination of these, is contrary to the Declaration of Oslo, and contravenes your Association’s ethical code.
