Cabinet usurped Privy Council

The Sovereign-Council, or Privy Council, was the chief instrument of executive power until the development of Cabinet Government. The council’s Judicial Committee is the final court of appeal from courts in British dependencies, courts in certain independent Commonwealth countries, courts in the Channel Islands and Isle of Man, professional and disciplinary committees, and ecclesiastical courts. The committee is composed of privy counsellors who hold or have held

high judicial office. In normal circumstances, only three or five committee members hear individual cases.

A Christchurch couple’s 12-year legal battle with the Christchurch Drainage Board was decided last month by the Law Lords.

They found in favour of Michael and Adrienne Brown after an appeal by the Drainage Board to the Privy Council against a judgment that the board should have warned the Browns about possible flooding from the Heathcote River.
