New trial ordered on sexual violation charge
A new trial has been ordered for Mark Cyril' Woodall, aged 26, a wood cutter, on a charge of sexual violation after a jury failed to reach a verdict in the High Court yesterday. After deliberating for more than six hours, the jury foreman told the Judge that it was unable to reach a verdict.
Evidence was given by a woman, aged 25, that Woodall arrived at her home at 1.20 a.m., while her de facto husband was absent, and told her that he would forget the $2OO her husband owed him if she would “turn it up for him.” The woman said that she rejected Woodall’s advances but he indecently assaulted her. His at-
tempts at intercourse failed. Woodall said that all his actions were committed with the woman’s consent but that suddenly she ran off screaming for help. He said they had been smoking cannabis but that was denied by the woman. Mr Brent Stanaway appeared for the Crown and Mr Nicholas Till for Woodall.
