Wigram use declined

An appeal to build a home on a Wigram property now used for horse breeding has been declined by the Planning Tribunal. The application by M. A. and J. R. Langan for conditional use of their 2ha Carrs Road property

was initially refused by the Paparua County Council in July, 1985. The appellant’s counsel said they wanted to build a three-bedroom house on the property. This would enable them to double their number of horses, which at most had been • three mares and three foals. Horse breeding was a predominant use in their area, zoned Rural 4. In upholding the council’s decision, the Planning Tribunal said the application did not meet the condition of being necessary for the development.

It felt the site was not capable . of sustaining more intense breeding, but even so the appellants were already using the site without needing to live there. Neither had the Langans expressed any intention of building a house there when they bought the land five years ago. But the tribunal felt it was bad practice for the council to try to control residential use of rural areas in this way. Because of “the planning significance inherent in such a decision,” the tribunal declined the appeal.
