Solicitor to stand trial
PA Auckland An Auck land solicitor has been committed for trial on a charge of false pretence involving $34,510. The man was granted interim suppression of name when he appeared for a preliminary hearing in the District Court at Auckland before Messrs J. Jaffe and W. H. Christmas, Justices of the Peace.
He pleaded not guilty to a charge that on or about July 15, 1982, with intent to defraud, he falsely represented that a property in Auckland was unencumbered and caused the Marac Building Society to write a cheque for $34,510 in
order that it might be used afterwards as a valuable security. Prosecution evidence was admitted by consent. A suppression order was placed on all evidence which could link the defendant with his former legal practice, sold earlier in the year.
The defendant’s counsel, Mr Patrick Finnigan, submitted that to publicise the whereabouts of the practice would be unfair on the buyer who was in no way connected with an alleged misconduct.
Bail was set at $lOOO with a similar surety. The trial will begin in the District Court on July 25.
