PA Wellington An application seeking dispensation from filing preliminary acts in a case in which three Wellington men are suing the AttorneyGeneral, Mr McLay, for an incident during a protest against the visit of the U.S.S. Texas, has been dismissed in the District Court at Wellington. The Deputy DirectorGeneral of Health, Dr A. L. Thorstensen, and two carpenters, Mr M. K. Rashbrooke and Mr Barney Hamid, are suing for $BOOO damages after a collision between Dr Thorstensen’s 3.6 m sailing dinghy Gonzo and a police boat. At yesterday’s hearing before Judge Borrin, sitting under Admiralty jurisdiction, Mr G. J. McCoy, for the trio, argued that prelim-

inary acts which must be filed according to the rules governing Admiralty jurisdiction required information not appropriate in the case of a collision between two dinghys. Questions which had to be answered included how many lifeboats the ship was carrying, who was on

the bridge, and was there an echo sounder and radar? Mr K. I. Murray, for the Attorney-General, said that the Court could be considerably assisted by the filing of preliminary acts by both sides. Judge Borrin dismissed the application.
