Adjournment of hotel incident hearing
An application to dismiss a claim for penalty for breach of award against the manager of Warners Private Hotel was opposed bv the Canterbury Hotel Workers’ Union in the Arbitration Court yesterday.
The claim arose after two union officials were denied permission to enter the hotel by the manager, Mr I. G. Kerr, on July 12. The officials were seeking to talk to staff and distribute notices of a union meeting. Counsel for Mr Kerr, Mr P. M. James, submitted to the Court on Monday that the proceedings should be dis-
missed. He claimed that union advocate, Mr R. Lin-" gard, had failed to discharge the burden as plaintiff. Yesterday Mr Lingard sub- •
mitted the union’s opposition * to Mr James' claim on non- - suit. Mr Lingard said that ' the union had proved its case beyond reasonable doubt and that the matter could not properly be dealt with “with- * out the defendant adducing - evidence in rebuttal."
The hearing of the substantive matter, before Chief Judge J. R. P. Hom and Messrs D. Jacobs and P. L. Oldham, has been further adjourned.
