Appeal petition nearly ready

PA Wellington Mr Justice Mahon said yesterday that his petition seeking the leave of the Privy Council to hear an appeal over the Court of Appeal ruling on his Erebus report was “about to be filed.” The petition would be sent soon to the Privy Council in London. The council's judicial committee would decide whether the council would hear the case, and if so, set a date.

Last December, the New Zealand Court of Appeal ruled that Mr Justice Mahon had exceeded his jurisidiction and breached natural justice in his findings on the

conduct of Air New Zealand in respect of the airline’s appearances before the Judge during his Royal Commission of inquiry into the November, 1979, DCIO Mount Erebus crash, which claimed 257 lives. The Judge, who retired after the appeal court decision, sought to appeal it on a point of law. The case for the Privy Council was being prepared by an Auckland barrister, Mr David Baragwanath, who was a counsel assisting the Judge’s commission of inquiry. The Government has agreed to carry the cost of the Privy Council appeal.
