Tribunal overturns parking decision
The Planning Tribunal has reversed a decision by the ;Kaiapoi Borough Council to .disallow a car sales yard ,on I part of a supermarket earmark. The council said that the district scheme code of ordinances required the supermarket to be served by 30 car-parking spaces. The car sales yard would leave fewer than that. At present the car-park has 38 spaces. The tribunal said the (claimed parking deficiency 5 arose because the council lhad insisted, outside its powers, that land which .could have been used for parking was set aside for landscaping. The supermarket was served by an immense car-parking space which also served a hotel. “It is quite nonsensical to suggest that there is inadequate parking in the vicinity of this supermarket.” | ’ The tribunal gave its consent subject to two conditions: that the ovyners of the land, or the. supermarket, (prepare a plan modifying (layout of the remaining (parking area before the car (sales business was set up !and that the yard be landescaped to the satisfaction of the Borough Engineer.
