NOTICE OF INTENTION TO INTRODUCE A LOCAL BILL THE Marlborough Harbour Board hereby gives notice pursuant to Standing Order 258 of the Standing Orders of the House of Representatives that It intends to introduce a Local Bill entitled the MARLBOROUGH HARBOUR AMENDMENT BILL 1977.

The objects of the Bill are: 1- To amend the extent of the Marlborough Harbour District by including parts of the Marlborough County and Kaikoura County nut within the Board’s original District but which have been included subsequently by orders made by the Local Government Commission.

2. To make provision for the erection, purchase, maintenance. rebuilding and administration of community jetties and, to provide for the constitution of community jetty districts within which the Board would be empowered to make and levy annually a uniform fee to be paid by the owner or occupier of each separate alotment with provision that such uniform fee may be made and levied in respect of each separately occupied building and each separately occupied portion of anv building. This provision ! is to enable the Board to limit the proliferation of jetties within its District and rationalise the position with regard to existing jetties. 3. To validate certain reclaI mations made in the Ptcton Harbour, Havelock Harbour and Kaikoura Harbour; to provide for the vesting of certain of the reclamations in I the Picton Harbour and the Kaikoura Harbour in the Board; to authorise the District Land Registrar to issue certificates of title in respect of the reclaimed areas thus vested In the Board and authorising the Board to sell such reclaimed lands with the consent of the Minister of Transport or to lease the same subject to the provisions of the Public Bodies Leases Act. The Bill provides that none of the provisions relating to reclamations shall limit the application of . the Public Works Act 1928, the Town and Country Planning Act 1953, the Counties Act 1956, or the Water and Soil Conservation Act 1967. 4. To empower the Board to grant leases of Marlborough Harbour Board Endowment lands in the Vernon Lagoons and at the Wairau Bar Pilot Station for terms ndt exceeding 33 years with or without rights of renewal perpetual or otherwise and upon other terms and conditions and at such rent as the Board may decide notwithstanding the provisions of the Public Bodies Leases Act 1969. 5 To provide for the beds of the ports and harbours under the jurisdiction of the Board to be evsted in the Board. The principal objectives of this provision are: (a) To make the Board the licensing and controlling authority for the purpose of the Marine Farming Act 1971; and, . (b) To make the Board the sole licensing and controlling authority for structures below mean low water mark, e.g., jetties and moorings. 6. To provide for the extension of the provisions of the Sale of Liquor Act 1962 relating to Liauor Licences at airports to include the Picton Ferrv Terminal thereby enabling application to be made for the appropriate liquor licences at the Picton Ferry Terminal. In compliance with Standing Order 259 copies of the Bill and the plans of the reclaimed areas in respect of which validation is sought mav be Inspected during ordinary office hours without fee at the Magistrate’s Court.
