MAGISTRATE’S COURT Periodic detention for false pretences and burglary

John Bingham, aged 24, a chef, who had previously pleaded guilty to charges of burglary and false pretences involving a total of $BOO, was sentenced to periodic detention for eight months when he appeared before Mr E. S. J. Crutchley, S.M., in the Magistrate’s Court yesterday.

Bingham was also placed on probation for one year, ordered to take out a prohibition order and ordered to pay restitution of $101.33. Mr N. R. W. Davidson, who appeared for Bingham, said the offences were committed when there was severe matrimonial discord in his life. He was unemployed, had no money, and was suffering from an alcohol problem. Mr Davidson said it was Bingham’s first appearance before the Court.

Sergeant R. J. Harlick previously told the Court that television and radio equipment and clothing worth $653 were stolen from a house in Dover Street on November 18. The property was later recovered from a house 30 yards away. Valueless cheques were issued by Bingham to obtain

PERIODIC DETENTION Stephen Wayne Ufren, aged 21, a painter (Mr A. J, Forbes), was sentenced to periq die detention for eight month s when he appeared on charg es of stealing a chain hoist and 7 a racing cycle, uttering a valueless cheque, and obtaining pet rol and money amounting to $3J;.40 by a false pretence. Uren had previously pleaded

guilty and been remanded for a medical examination. He was ordered to pay restitution of $97.40. TWO YEARS PROBATION Larry Turk, aged 28, a moulder (Mr P. Graham), was released on probation for two years when he was sentenced on three charges of indecently assaulting a male and three charges of inducing another male to do an indecent act upon him. As special conditions of probation, Turk was ordered to undergo psychiatric or medical treatment as directed. He had previously pleaded guilty and been convicted. BROKE WINDOW A man who pushed his wife through a plate-glass shop window during a domestic dispute in Manchester Street was charged with wilful damage and given a deferred sentence. Tai Manu, aged 30, a sickness beneficiary, pleaded guilty to breaking the shop window, and was ordered to come up for sentence within six months if called upon. He was also ordered to pay $6O restitution. Sergeant Morgan said Manu was arguing with his wife outside a music store in Manchester street about 10.30 p.m. on November 24. Several blows were traded and during the fracas the defendant pushed his wife Into the window. The window smashed, and his wife found herself Inside the shop. For Manu, Mr R. F. B. Perry said he did not normally behave in the manner described by the police, but he was drunk at the time. The Magistrate said he noted that the damage was not a direct result of the defendant’s actions. THEFT OF RADIO Two young men were each fined $5O and released on probation for 12 months after pleading guilty to a charge of stealing a car radio worth $25. William Paul Clarke and William Richard Rawiri, both aged 21, and employed as mechanic’s labourers (Mr P. N. Duncan), were said to have removed the radio from a car they were taking apart in their employer’s wrecking yard. Sergeant Morgan said the radio was hidden in long grass. When (questioned about it by their employer, the defendants at first denied knowledge of it. They later told the police they had experienced difficulty living on their weekly wage. Clarke said he intended to sell the radio. Rawiri told the police he intended to put it back in the Mr Duncan said that Rawlri’s part in the offence was a minor one; he removed the radio from its mountings and left it on the car seat. THEFT OF MONEY Stephen Knighton, aged 17, a salesman was released on probation for 18 months, fined $5O and ordered to pay restitution of $lO9 when he was sentenced on charges of stealing $lO9 on October 18 and stealing $2 on November 8. On both occasions the money was stolen from the wallet of another member of the staff where he was employed. SHOP THEFT Kathleen Nora Allen, aged 55, a married woman (Mr J. R. Milligan), pleaded guilty to a charge of stealing a powder compact worth 76 cents from the Bishopdale branch of Woolworths (N.Z.), Ltd. on November 17. She was convicted and fined $2O.

Sergeant Morgan said the defendant had a previous conviction for a similar offence.

“Anyone who commits a second offence of shoplifting comes very close to imprisonment.” the Magistrate said. DANGEROUS DRIVING A young motor-cyclist and a car driver were fined and disqualified from driving for driving dangerously along Tucker’s Road on October 6. The motor-cyclist, John Raymond David Currie, aged 18, a plant operator, was fined $lOO, and disqualified for nine months after pleading guilty to driving at a speed and in a manner which might have been dangerous. The car driver, John Richard Freeman aged 18. an apprentice electrician, was fined $7O and disqualified for nine months for driving in a dangerous manner. The Magistrate imposed a lesser fine on Freeman because of his lower wages. He pleaded guilty. (Before Mr W F. Brown, S.M.) INDECENT ASSAULT A man, whose name was suppressed, was convicted on a charge of indecently assaulting another male and remanded on bail to December 12 for sentence. He pleaded not guilty and was represented by Mr C. A. McVeigh. ASSAULTED MOTORIST After a minor collision between two cars on Papanui Road about 7 p.m. on September 24, an argument between two motorists ended when one gave the other a backhanded blow across the ear.
