Stakes refund ordered
The lessees of Pavlova’s Pal and Dantic, two Riccarton-trained gallopers, were ordered to refund stakes totalling $1395 when the horses were disqualified from the stake-bearing placings at inquiries held in Christchurch yesterday.
The inquiries were held by a specially convened subcommittee of the executive committee of the New Zealand Racing Conference. It comprised Messrs J. E. Brunton (chairman), P. D. Hall, and W. A. H. Thompson. The charges were preferred by a racecourse inspector, 'Mr K. T. F. Samson, against Messrs E. P. and P. Kipa, and Mrs J. A. Kipa, the lessees of Pavlova's Pal, and Messrs B. R. Perreau and J. N. Phillips, the lessees of Dantic. The charges against all the parties arose out ot disabilities to which the respective horses were subject by the virtue of the provisions of Rule 103 of the Rules of Racing. The charges, which were all admitted, in each case related to the entry and starting of fhe horses contrary to tile provisions of the rules. In a statement released after the inquiries, the subcommittee said:—
“In respect of the charges preferred against Messrs Perreau
and Phillips, there was also involved for the consideration of the sub-committee the matter of stakes earned by Dantic at race meetings at Dunedin and Timaru when it was not eligible to be entered or started.
"After hearing from Mr Samson, the sub-committee expressed the view that the lessee Mr Phillips was Ignorant of the reason for the horse’s disability and imposed no penalty.
"However, in the opinion of the subcommittee, this did not apply to Mr Perreau. He was fined $5O.
“It ordered, as it was compelled to do by the Rules of Racing, that Dantic be disqualified from the two races in which it earned stakes, and further ordered that the lessees refund to the Racing Conference, pursuant to Rule 321 (b) the sum of $l9O which had been paid to them as stakes earned by Dan-

that the lessees Mrs J. A. and P. Kipa were unaware of the reason for the horse’s disability, and Imposed no penalty.
*Tt considered- that E. P. Kipa was, or should have been, fully aware that the horse was not eligible to be entered or started in a race. A fine of $5O was imposed.
The subcommittee ordered that Pavlova’s Pal be disqualified from the three races it had won and ordered that the lessees refund $1205 which had been paid to them as stakes earned by Pavlova’s Pal.
TRAINER FINED The Riccarton trainer, V. D. Clutterbuck, was fined $25 for falling to scratch Quick Magic and Santa Fae, which were acceptors for races at meetings
held by the Kurow Jockey Club and the Southland Racing Club on January 3 from one of their engagements by noon the day before. Clutterbuck, who admitted the charges, pleaded Ignorance of Rule 238 (6) involved.
The sub-committee, which heard the charges, preferred by a stipendiary steward, Mr L. J. Muirhead, said in a statement that it pointed out to Mr Clutterbuck that the rule was for the benefit of the racing public, and that trainers should be conversant with the rules. In view of his excellent record, however, it decided to Impose a lenient fine.
