AUCKLAND, July 14. An Auckland textile firm, Abbott, Armstrong and Howie, Ltd, was fined a total of $3135 by Mr A. A. Coates, S.M., for customs breaches. The firm was ordered to pay $320 in Court costs and $855 in solicitors' fees.

The company had pleaded guilty to 61 Informations and three others were found to have been proved. These included prohibited importation, erroneous entry with intent to defraud the Department of Revenue, and erroneous entry without intent to defraud. “In a number of cases a clear intent emerges that the company embarked upon the importation of articles with the clear intention of defrauding the authorities,” the Magistrate said. In fixing penalties be had taken into account the possibility of differences of opinions on customs tariff classes and the possibility of honest mistakes leading to diminished responsibility.
